According to the judge, Walker and Roger Rodas’ fatal crash in 2013 was not Porsche’s fault, and the alleged design defects in the 2005 Porsche Carrera GT can only be speculation.
All four allegations filed by Rodas’ widow, including negligence, wrongful death and product liability, have been thrown out at court.
Kristine Rodas alleged that design defects in the 2005 Porsche Carrera GT were responsible for the crash killing the Fast and the Furious actor and her husband, who was driving the car on November 30, 2013.
TMZ reports:
[Rodas] claimed the passenger compartment wasn’t sturdy enough to withstand impact. The judge said Rodas’ fatal injuries occurred when he actually was hurled into Paul Walker.
Kristine claimed the car was not built to withstand side impact. The judge noted Kristine’s own expert said the fatal force came from the front — hitting the light pole — and not the side.
The judge also shot down the claim that the fuel cell was compromised, causing a fire. But the judge concluded fire was not the cause of Rodas’ death.
And the last claim … something failed in the car’s suspension. The judge said the proof just wasn’t there.
Walker’s daughter Meadow has also filed a wrongful death lawsuit against Porsche. Although the judge has yet to rule on her lawsuit, this outcome unfortunately strongly forecasts how her’s will go as well.
