Taylor Swift: Will She Sue Kanye West Over Naked ‘Famous’ Video Figure? — Attorney Speaks

Taylor Swift must be assessing her legal options after a lifelike naked wax figure of the ‘Blank Space’ singer appeared in Kanye West’s shocking new video ‘Famous’ alongside the hip-hop star in bed. But would she be able to really sue him? HollywoodLife talked EXCLUSIVELY with an attorney to find out!

What’s her next move? Taylor Swift, 26, is not happy about being depicted as a naked wax figure model, with a host of other celebrities, in the new and controversial video for Kanye West‘s new song “Famous.” But from a legal standpoint, would she be able to sue the hip-hop star for defamation? HollywoodLife spoke with top Californian attorney, David Pisarra who explained all. Click down to see if Taylor has a case!

So, just to recap, a wax figure of Taylor appears naked in bed alongside Kanye, as well as other famous faces including Donald Trump, Rihanna and Kim Kardashian in the incredible video. Lawyer David says she could sue, but chances of winning a suit are very slim.

“Taylor Swift can sue Kanye West for the video but she will likely not get very far in court,” he told HollywoodLife “She can sue for defamation of character and for misappropriation of name and likeness but it will be hard for her to prove damages in court. No one is going to stop buying her albums or going to her concerts cause Kanye used something that looks like a topless Taylor in his video. She will likely lose the suit if it doesn’t get thrown out. Any lawsuit she brings against Kanye maybe just for publicity reasons.”

David says that where Taylor might be able to force through a women’s rights libel case, but again her lawyers could say it’s a no-go. He continued: “Taylor may hang her suit on a woman’s rights label. She could say why were the women’s breasts exposed but none of the men’s private parts? Taylor’s lawyers may advise her not to file the frivolous lawsuit and instead to issue a statement condemning the video. As a celebrity she is subject to these types of things in media and her level of privacy is different than non-famous people.”

And there’s also the option of a class-action lawsuit, but she would need some or all of the celebs featured to join. David concluded, “Another avenue Taylor could pursue would be a class-action lawsuit against Kanye. This would require her to get some or all of the people in the video to join her in suing Kanye. Again, she would not get far in court and would likely fail.”
